Hrnčíř E. 1 , Mikyska M. 2

1 Klinika nemocí z povolání Univerzity Karlovy v Praze, 3. lékařská fakulta, přednosta doc. MUDr. Evžen Hrnčíř, CSc. 2 JUDr. Martin Mikyska, advokát se sídlem v Praze a na Malé Skále

Summary:

If it is revealed that the decision on the presence of an occupational disease depends on the interpretation of testimonies, on the evaluation of facts which are not purely medical or if certain materials are lacking which are important for medical evaluation of the problem, health workers should not implement the legal act of certifying an occupational disease. In that instance this is solely within the competence of a legal court.
