ŠIMEK J.

Ústav pro lékařskou etiku a ošetřovatelství, 3. lékařská fakulty UK v Praze

Summary:

Explanation of currcnt Czech legal status of informed consent is presented. The main law is the Conventi- on on Human Rights and Biomedicine. Its direct application is possible only in those provisions which are self-executing. The basic Czech law is Law No. 20/1966 on care for health of people. It is possible to show incongruity in some articles and some provisions of the Convention need speciál provisions which are lacking. Institute of informed consent is gradually incorporated in the Czech health care facilities; its exercise should be improved.

Key words: institute of informed consent; convention on Human Rights and Biomedicine
