There have recently been increasing numbers of patients reporting health damage due to the provided health care. There are also frequent situations, where the radiologist – participating in the diagnostics and therapy – is on the verge of criminal prosecution. The aim of this contribution is to provide the radiologists with basic information from the point of view of legal expert in the area, what should the most rational attitude be if he/she is a threatened with a legal accusation. In a separate part the author draws attention to the obligation to notify mistreatment of the commended person. Due to the large extent of the problem the communication does not include the questions of written consent of the patient before an intervention and typical criminal acts against the life and health.
